Terms and Conditions of Carriage

(For Tokyo MK’s Passenger Transportation Services)
1. Scope of Application

These Terms and Conditions apply to all passenger transportation services operated by Tokyo MK.
Any matters not specified here will follow applicable laws or general business practices.
If Tokyo MK agrees to special arrangements that do not conflict with these Terms or relevant laws, those special agreements will take precedence.


2. Passenger Conduct and Staff Instructions

To ensure safety, passengers are required to follow instructions from Tokyo MK drivers and staff during service.

 

3. Acceptance of Transportation 

Except in the cases listed below, Tokyo MK will accept passenger transportation requests.

 

4. Refusal or Discontinuation of Service 

Tokyo MK may refuse or discontinue service in the following cases: 
(1)The request does not comply with these Terms and Conditions. 
(2)Suitable vehicles or facilities are not available. 
(3)The customer requests unreasonable conditions or burdens.

    ・Note: For long-distance trips (approximately 50 km or more outside our regular service area) requiring toll roads, Tokyo MK may request payment equivalent to the round-trip toll fees. The return toll applies only up to the nearest toll gate within our service area.

    ・In such cases, this policy will be clearly displayed inside the vehicle, and the driver will explain it to the passenger in advance.
(4)The trip violates laws, public order, or good morals. 
(5)Service cannot continue due to natural disasters or unavoidable circumstances. 
(6)The passenger does not follow safety-related instructions from the driver. 
(7)The passenger carries prohibited items as defined by transport regulations. 
(8)The passenger is severely intoxicated and unable to clearly state their destination or walk unassisted. 
(9)The passenger’s clothing or condition may soil or damage the vehicle interior. 
(10)The passenger is seriously ill and without an attendant. 
(11)The passenger has (or is suspected of having) a serious infectious disease as defined by law. 

5. Non-Smoking Policy 

Smoking is not permitted in Tokyo MK vehicles designated as non-smoking.
If a passenger smokes or attempts to smoke, the driver may ask them to stop.
If the passenger refuses, the driver may discontinue the trip. 

 

6. Fares and Charges 

Fares and fees are based on rates approved or filed with the Regional Transport Bureau at the time of boarding.
Unless a time-based charter has been arranged, the fare shown on the taxi meter applies. 

 

7. Payment 

Fares and fees must be paid when the passenger exits the vehicle.

8. Company Responsibility 

If a passenger is injured or loses their life due to the operation of a Tokyo MK vehicle, the Company will compensate for damages, except in cases where:

(1)The Company and its staff exercised due care,

(2)The incident was caused by the passenger or a third party, or

(3)The vehicle had no structural or functional defect.
This responsibility begins when the passenger boards and ends when they exit the vehicle.

9. Other Damages

Tokyo MK is also responsible for damages arising during transportation unless it can be proven that the Company and its staff took all reasonable care.

 

10. Service Suspension 

Tokyo MK is not responsible for any damages caused by temporary suspension or delay due to natural disasters or other circumstances beyond the Company’s control.

11. Passenger Responsibility 

If a passenger causes damage to Tokyo MK—whether through negligence, willful misconduct, or violation of laws or these Terms—the passenger will be held responsible for compensating the Company.
